Decree of separation of Ministry Oil from Ministry of Finance 1975 AD



We, Sabah Al-Salem Al-Sabah, Amir of Kuwait,
Having reviewed article 72 of the Constitution
The Amiri decree No. 2/1962 for reorganization of the Ministry and its Amending decrees.
The decree of the cabinet formation issued on 27/1/1395 A.H. corresponding 9/2/1975 A.D.
Upon the presentation made by the prime minister
And upon the cabinet approval .
Decreed as follows:


First Article:

There shall pass to the Ministry of Oil the powers of Ministry of Finance and Oil in terms oil and gas affairs. Departments shall be appropriated between the Ministry of Finance and the Ministry of Oil as stated in the following articles:


Second Article :

The following departments shall be attached to the Ministry of Finance

State Domain & Services Dept.
General Accounting Dept.
General Budget Dept.
Retirement Dept.
Investment Dept.
General Administration of Shuaiba Industrial Area.

Third Article:

The following departments shall be attached to the Ministry of Oil.:

Oil Economic & Legal Affairs Dept.
Technical Affairs Dept.
Industrial Relations and Employment Dept.
Oil Affairs Office of the Natural Zone.

Fourth Article:

Under the agreement between the Ministry of Finance and the Ministry of Oil, there shall be listed the companies which the government has had shares thereof and whose primary business is based on oil and gas mining distribution, marketing, processing or transport thereof as well as the oil projects in which the state has invested some of its reserve funds.
The task of managing the government shares of these companies and supervision on these projects is assigned to the Ministry of Oil.

Fifth Article:

An appropriate number of the employees and servants of Administrative Affairs Department, Personal Affairs Control and confidential Achieves Section ad the Ex-Ministry of Finance and Oil shall be assigned to each of the Ministry of Finance and Ministry of Oil subject to mutual agreement of the Ministers of these two Ministries.

Sixth Article:

By virtue of cabinet resolution, there shall be assigned to each of the Ministry of Finance and The Ministry of Oil a sufficient number of the undersecretaries and assistant undersecretaries for the Ministry of Finance and Oil.

Seventh Article :

Salaries of the employees assigned to both of Ministry of Finance and Ministry of Oil in execution of the provisions hereof shall be paid out of the budget of Ex-Ministry of Finance and Oil. The Minister for each Ministry shall cause payment from the provisions stated in the budget of departments attached to his Ministry until the budget of the fiscal year 1975/1976 is issued.

Eighth Article :

Each of the Minister of Finance and The Minister of Oil may amend the title and powers of departments, controls and sections attached to his Ministry as well as merge or sub divide them or form new departments, controls or sections based on the Ministry business needs.

Ninth Article :

The prime Minister, the Minister of Finance and the Minister of Oil shall each within his powers execute this decree. This decree shall come into effect from its date of issue and shall be published in the official gazette. The prime Minister shall present it to the National assembly.
